Unless they've changed VERY recently, there is no FCC regulation preventing
it. I've scanned the applicable FR stuff and I haven't found anything new
on the subject (but it might have been tucked in to some othe rule change).
My 47 CFR is about six months out of date.

Of course, many of the carriers ask that you not use their service airborne.
